Acceptance
By signing in to xHermes (via X or by connecting a Solana wallet) or by using a provisioned Hermes agent, you agree to these terms and to the Privacy Policy. If you don't agree, don't use the service.
We may update these terms. Material changes will be reflected in the updated date at the top of this page, and continued use after a change means you accept the revised terms.
What the service does
xHermes provisions and manages a Hermes agent — an autonomous agent from Nous Research — in an isolated container, one per user. You interact with your agent through a branded dashboard and console. Hermes itself is a separate open project; we provide the hosting, the per-user isolation, the model key, and the credit cap.
Eligibility
- You must be at least 18 years old, or the age of majority where you live.
- You must have the legal capacity to enter into this agreement.
- You must not be on any applicable sanctions list, and you must not be located in a jurisdiction subject to comprehensive sanctions by the United States, the United Kingdom, or the European Union.
- One agent per user. Don't create multiple accounts to circumvent caps or bans.
Accounts & authentication
You authenticate either by signing in with X or by signing a one-time message from a Solana wallet you control. You're responsible for the security of the account or wallet you use to sign in. We don't reset accounts based on lost wallets — if you lose access to your signing wallet and have not linked an X handle, your agent may become inaccessible.
Cookies are used only to maintain your authenticated session. See Privacy Policy.
Acceptable use
You agree not to use xHermes or your agent to:
- Break the law, infringe anyone's rights, or generate content that sexually exploits minors.
- Attack, probe, or attempt to compromise xHermes infrastructure, other users' agents, or any third-party system we connect to.
- Evade our credit cap, rate limits, isolation boundaries, or authentication.
- Send spam, run influence operations at scale, or impersonate others to deceive.
- Resell raw access to the service, the model key, or the container without our written permission.
- Train competing foundation models on outputs of the service, or scrape the service to build a derivative dataset.
We may suspend or terminate access for violations, with or without notice depending on severity.
The agent, the model, the cap
Your agent talks to a language model through a key we mint for you with a hard credit cap. When the cap is reached, the agent stops calling the model. There is no surprise bill — the key cannot spend more than its cap, and we will not raise the cap silently.
You may instead connect your own SuperGrok key from xAI, in which case billing for model usage goes directly to your xAI account and our cap does not apply to that key.
You are responsible for what your agent does on your behalf, including content it generates and actions it takes on connected accounts (e.g. X via xurl).
Billing & credits
Credits are a prepaid balance used to cover model spend through the xHermes-issued key. They have no cash value, are not refundable except where required by law, and are not transferable between accounts.
Credit purchases are settled on-chain. The blockchain transaction IDs of those purchases are stored alongside your account so we can attribute the credit. See Privacy Policy for the full list.
Wallet-gated free access is conditional on continuing to hold the required amount of the official token. If your balance falls below the threshold, free access pauses until you're above it again. Your agent state is preserved.
Tokens, wallets, and risk
The official xHermes token is a utility access token. It is not a security, not an investment contract, and not a claim on revenue or governance. Nothing on this site is financial, legal, or tax advice.
- No custody. We never see, move, or hold your tokens or private keys. Wallet onboarding is a pure signature on a one-time message.
- Crypto carries risk. Tokens can lose value. Markets can be illiquid. Smart contracts can have bugs. You are responsible for your own due diligence and your own risk.
- No price guarantees. Nothing on this site is a promise about the price, supply, or trajectory of any token.
Uptime & service level
We target 99% monthly uptime for the xHermes dashboard and the agent control plane. This is a target, not a contractual SLA — we do not offer service credits for downtime. Planned maintenance, third-party outages (model providers, X, RPC nodes), and force majeure are not counted against the target.
We may pause, throttle, or scale down agents that are idle, in abuse, or causing outsized resource pressure.
Third-party services
xHermes integrates with third-party services you choose to connect — X, xAI / SuperGrok, model providers, blockchain RPCs. Their terms apply to your use of those services through your agent. We're not responsible for their decisions, outages, or enforcement actions.
Your content & ours
You retain ownership of the prompts, files, and SOUL.md you provide, and of the outputs generated by your agent on your behalf, subject to the rights of model providers and any third parties whose content is referenced.
You grant us a narrow, internal license to process your content purely to operate the service — store it in your agent container, forward it to the model, return results to you. We don't use your prompts or outputs to train models or to build derivative products.
The xHermes brand, site, and code are ours (or our licensors'). Hermes itself is open and remains the work of Nous Research; their licenses govern its use.
Termination
You can delete your agent and end your use of the service from the dashboard at any time. Deletion removes the container, its memory, and stored secrets. There is no soft-delete.
We may suspend or terminate your access if you breach these terms, if required by law, or if continued operation would put other users at risk. Where reasonable we'll give notice; where the situation is serious we won't.
As is, no warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We don't warrant that the agent will produce correct, complete, or safe outputs. You are responsible for reviewing outputs before relying on them.
Limitation of liability
To the maximum extent permitted by law, xHermes is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or loss of goodwill, arising from or related to your use of the service.
Our total aggregate liability for any claim arising from or related to the service is limited to the greater of (a) the credits you paid xHermes in the 90 days before the claim arose, or (b) one hundred US dollars (USD 100).
Some jurisdictions don't allow these limitations. In those places, the limitations apply to the maximum extent permitted.
Indemnity
You agree to defend and indemnify xHermes and its operators against claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, your content, your agent's actions on your behalf, or your breach of these terms.
Disputes & governing law
These terms are governed by the laws of the jurisdiction where the operator of xHermes is established, without regard to conflict-of- laws rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection rules in your country require otherwise.
